As may be amended from time to time, these terms and conditions apply to all our services directly or indirectly (through distributors) made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and/or using our (mobile) website or any of our applications through whatever platform (hereafter collectively referred to as the "Platform"), you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the Privacy Policy).
TRAVEL DOCUMENTS
It shall be the User's sole responsibility to ensure they own valid travel documents such as identity proof, passport, visa (including transit visa), etc., to undertake the travel. User agrees that in case of inability to travel for not carrying valid travel documents, PISPL shall in no way be held liable.
The User understands that the information (if any) provided by PISPL regarding the travel documents is only advisory in nature and can't be considered conclusive. The User shall ensure checking the travel requirements with the respective airlines of the respective jurisdictions the User may transit through or choose to visit.
ROLE OF PISPL AND LIMITATION OF LIABILITY
PISPL solely acts as a facilitator for visa processing and is not responsible for granting or rejecting User(s) visas in any manner whatsoever. Issuance of visa is a sole decision of concerned Embassy.
Services offered by PISPL should not be considered or construed as Visa advisory or consultancy in any manner as it acts on the User's instruction. The User understands that he is solely liable to understand the visa requirement to undertake the travel booked for the desired destination country/countries and then instruct PISPL accordingly to initiate the Visa application process.
PISPL role is limited to informing the User about the documentary requirements for applying for a visa of a specific country or jurisdiction, collecting those documents as provided by the User, and submitting those documents to the respective Embassy or high commission. Such requirements for making a visa application (including, but not limited to, documentation, fees and time frames) are provided by PISPL based on the information provided by the respective Embassy or high commission. PISPL can not advise on the documents' merit, completeness, or the suitability or likelihood of approval or rejection of the visa being applied for.
PISPL may also inform the average time to process a visa application by the respective Embassy or high commission. However, it is the User's responsibility to approach PISPL for visa application in a time-bound manner.
Each country has varying requirements for passports and visas. For instance, certain nations require a minimum number of blank pages in succession or a certain minimum balance period of validity of the passport. Those respective countries establish these requirements and are subject to change without notice. While PISPL will make best efforts to ensure that its User(s) are given correct and updated information, there may be instances where the requisite information is not made available to PISPL, as a result of which PISPL may not be able to provide the same to its customers. PISPL will not be held responsible for any inaccuracy in such information in such cases.
The visa approval or rejection is at the sole discretion of the respective Embassy or the high commission to which the visa application is submitted. PISPL has no role in either assessing or processing the visa application. Such approval or rejection depends on many factors, such as the information provided by the User, current or previous nationality, place of application of visa, residence, gender, age, profession, recent travel and religion.
On the User's behalf, the concerned consulate, Embassy or High Commission may call the User for a face to face interview, at its sole discretion. PISPL shall have no role to play in this process. PISPL will inform the User about the date, time and any other requirements as communicated by the concerned Embassy or High Commission for the interview.
PISPL may also appoint third party vendors for the visa application process for different countries. Such third-party vendors will be responsible for applying for customers' visas for the respective countries they have been appointed for.
For visa applications where submission of passports is required, PISPL shall take all necessary steps to ensure that the passport is delivered safely to the User. However, PISPL shall not be held liable if the passport is lost in transit or misplaced by the logistics service provider.
PISPL shall not be held liable for the acts and omissions of any consulate, Embassy, authorities in delaying or not issuing the visa for any reason whatsoever. PISPL also cannot be held liable for any incidental cost/expenses incurred by the User. In certain instances, even when a visa is issued, the User may be denied entry as it is the local immigration authorities who have the final say on the entry decision.
THIRD-PARTY NORMS
IN NO EVENT SHALL THE AGGREGATE LIABILITY OF PISPL, ITS AFFILIATES OR ITS THIRD-PARTY PROVIDERS, UNDER, OR OTHERWISE IN CONNECTION WITH, THESE TERMS (INCLUDING THE SITE AND THE PLATFORM), EXCEED THE TOTAL AMOUNT OF FEES PAID BY YOU (IF ANY) IN THE SIX (6) MONTHS IMMEDIATELY BEFORE THE EVENT GIVING RISE TO SUCH LIABILITY. THE PREVIOUS EXCLUSIONS AND LIMITATIONS OF LIABILITY SHALL APPLY: (A) EVEN IF PISPL, ITS AFFILIATES OR THIRD-PARTY PROVIDERS, HAVE BEEN ADVISED, OR SHOULD HAVE BEEN AWARE, OF THE POSSIBILITY OF LOSSES OR DAMAGES; (B) EVEN IF ANY REMEDY IN THESE TERMS FAILS OF ITS ESSENTIAL PURPOSE; AND (C) REGARDLESS OF THE THEORY OR BASIS OF LIABILITY (SUCH AS BUT NOT LIMITED TO, BREACH OF CONTRACT).
NO ACTION, REGARDLESS OF FORM, MAY BE BROUGHT BY YOU AFTER THE EARLIER OF (A) 12 MONTHS AFTER THE DATE ON WHICH YOU BECOME AWARE THAT A CAUSE OF ACTION HAS ARISEN, OR (B) THE PERIOD SET FORTH UNDER THE APPLICABLE STATUTE OF LIMITATIONS.
MODIFICATIONS
We reserve the right, at our discretion, to change these Terms at any time. Your continued use of the Site and/or Platform after that means that you accept those changes.
